Often we can create
equity by negotiating with your lender to reduce
the debt. Once the lender is willing to take less than what
is owed
you can either sell the home or do the lease option program. |

Why
is using a Realtor not a good idea? |
We seen too many houses listed
that are in
foreclosure end up going to
foreclosure
because the house didn't sell. Remember, you only have a short
time frame
to sell the house and in today's market houses aren't selling
quickly like in the
past. They may sit for six months or longer. You don't have that
long.

Should
I consider declaring Bankruptcy? |
We have found in most cases that
bankruptcy mostly only delays the foreclosure.
According to statistics approximately 80% of the people who do a
chapter 13 end up back into foreclosure again. Once you miss a
single payment to your lender they can petition the court to
restart the foreclosure process and often set the foreclosure sale
date within a few weeks instead of months. Whether you declare
chapter 7 or 13 you still will have to pay your secure creditors
and bankruptcy will remain on your credit up to ten years. |

Can
I still owe the bank after the foreclosure sale? |
This is called a deficiency
judgment. This can happen if the lender doesn't
receive it's full amount at the foreclosure auction. For example,
you put a 2nd mortgage on after you bought the property for 50K
and the first mortgage holder is owed 200K. The first mortgage
holder is foreclosing and at the sale the highest bidder is 200K.
What did the 2nd mortgage holder receive? Nothing! They
get the excess above the 200K which was zero. Guess who they are
going to go
after for their loss? You say I don't have anything but they know
some day you'll
get back on your feet and will have to deal with them in the
future. So if you can avoid the foreclosure and work it out with
your lender that is your best option.
